STANDARD TERMS AND CONDITIONS OF SALE
1. Acceptance of Terms
- By engaging the services of The Byte Farm, the client explicitly waives its own standard terms and conditions and agrees to adhere to the terms outlined herein.
2. Payment Terms
- Setup and startup fees are due prior to the commencement of work.
- Ongoing service fees are billed monthly and are due within 10 days of the end of each billing cycle. Payments are accepted via wire transfer or ACH.
- A late fee of $25 per user license will be applied to invoices for payments received after the due date.
- Custom development is billed upon completion. Any modifications or additional work will be treated as a new order.
3. Cancellation Policy
- Cancellations require a 90-day notice and must be communicated via email to info@thebytefarm.com.
4. Intellectual Property
- All custom development code remains the property of The Byte Farm unless otherwise agreed upon in writing.
5. Reporting of Issues
- Clients are required to report any problems, requests, or issues through the support system available at thebytefarm.com.
6. Liability and Warranties
- The Byte Farm endeavors to deliver high-quality services. However, no specific guarantees or warranties are provided beyond the effort to rectify reported issues as per our standard service agreement.
- The Byte Farm is not liable for indirect or consequential losses due to software malfunctions or service interruptions.
7. Governing Law
- All contractual relations between The Byte Farm and its clients shall be governed exclusively by the law applicable in the jurisdiction of The Byte Farm's primary place of business.
